1. مقدمة وقبول الشروط

تُشكل هذه الوثيقة اتفاقية قانونية ملزمة بينك (ويُشار إليك بـ “العميل” أو “المستخدم”) وبين موقع “أنس للتصميم الجرافيكي” (ويُشار إليه بـ “نحن” أو “الموقع” أو “المصمم”). تحكم هذه الشروط استخدامك للموقع وجميع الخدمات المقدمة من خلاله.

2. نطاق الخدمات

يقدم موقع “أنس للتصميم الجرافيكي” مجموعة متنوعة من خدمات التصميم الجرافيكي، والتي قد تشمل على سبيل المثال لا الحصر: تصميم الشعارات، الهوية البصرية، تصميم المطبوعات، تصاميم وسائل التواصل الاجتماعي، وتصميم واجهات المستخدم. يتم تحديد النطاق الدقيق للعمل، والمخرجات النهائية، والجدول الزمني لكل مشروع في “عرض السعر” أو “اتفاقية المشروع” المنفصلة التي يتم الاتفاق عليها قبل بدء العمل.

3. التزامات العميل

لضمان سير العمل بسلاسة وتقديم أفضل النتائج، يلتزم العميل بما يلي:

•تقديم موجز واضح ومفصل (Brief) يوضح متطلبات المشروع وأهدافه.

•توفير جميع المواد اللازمة (مثل النصوص، الصور عالية الدقة، الشعارات السابقة) في الوقت المناسب.

•الرد على الاستفسارات وتقديم الملاحظات على المسودات خلال فترة زمنية معقولة لا تتجاوز 3 أيام عمل، لتجنب تأخير المشروع.

•يضمن العميل أنه يمتلك الحقوق القانونية لاستخدام أي مواد أو نصوص أو صور يقدمها للمصمم لإدراجها في التصميم، ويتحمل المسؤولية الكاملة عن أي انتهاك لحقوق الملكية الفكرية للغير.

4. سياسة التعديلات والمراجعات

نحن نؤمن بأهمية رضا العميل، ولذلك نقدم سياسة واضحة للتعديلات:

•يتضمن كل مشروع عددًا محددًا من جولات التعديل (عادةً من 2 إلى 3 جولات) يتم النص عليها في اتفاقية المشروع.

•تشمل التعديلات تغييرات في الألوان، الخطوط، أو تعديلات طفيفة في التخطيط، ولا تشمل تغيير المفهوم الأساسي (Concept) بعد الموافقة عليه.

•أي طلبات تعديل إضافية تتجاوز العدد المتفق عليه، أو طلبات لتغيير المفهوم الأساسي بالكامل، ستخضع لرسوم إضافية يتم تقييمها بناءً على حجم العمل المطلوب.

5. الرسوم وشروط الدفع

تخضع جميع المشاريع لشروط الدفع التالية ما لم يُتفق على خلاف ذلك كتابياً:

•الدفعة المقدمة: يُشترط دفع عربون غير مسترد بنسبة 50% من إجمالي قيمة المشروع قبل البدء في أي عمل تصميمي.

•الدفعة النهائية: يتم سداد النسبة المتبقية (50%) بعد الموافقة النهائية على التصميم وقبل تسليم الملفات المصدرية أو النهائية عالية الدقة.

•طرق الدفع: نقبل الدفع عبر التحويل البنكي، أو بوابات الدفع الإلكتروني المعتمدة والموضحة في الفاتورة.

•التأخير في الدفع: في حال تأخر العميل عن سداد الدفعة النهائية لمدة تزيد عن 14 يوماً من تاريخ الموافقة النهائية، يحق لنا تعليق تسليم الملفات وقد تُفرض رسوم تأخير.

6. حقوق الملكية الفكرية وحقوق الاستخدام

تُعد مسألة حقوق الملكية الفكرية من أهم بنود التعاقد في مجال التصميم الجرافيكي:

•ملكية التصاميم النهائية: بمجرد استلام الدفعة النهائية كاملة، تنتقل حقوق الاستخدام التجاري للتصميم النهائي المعتمد إلى العميل.

•الملفات المصدرية: ما لم يُنص على خلاف ذلك في اتفاقية المشروع، فإن الملفات المصدرية المفتوحة (مثل ملفات PSD, AI) تبقى ملكاً لموقع “أنس للتصميم الجرافيكي”. يمكن للعميل طلب شراء الملفات المصدرية مقابل رسوم إضافية.

•المسودات والأفكار المرفوضة: جميع المفاهيم، والمسودات، والأفكار التي تم تقديمها للعميل ولم يتم اختيارها تبقى ملكية حصرية لموقع “أنس للتصميم الجرافيكي”، ولا يحق للعميل استخدامها أو تعديلها.

•حق العرض (Portfolio): يحتفظ موقع “أنس للتصميم الجرافيكي” بالحق في عرض التصاميم النهائية في معرض أعماله (Portfolio)، وموقعه الإلكتروني، وحساباته على وسائل التواصل الاجتماعي لأغراض الترويج، ما لم يطلب العميل صراحةً الحفاظ على سرية المشروع قبل بدء العمل.

7. الإلغاء والاسترداد

•إلغاء من قبل العميل: في حال قرر العميل إلغاء المشروع بعد بدء العمل، فإن الدفعة المقدمة (50%) تُعتبر غير مستردة لتغطية الوقت والجهد المبذولين. إذا كان حجم العمل المنجز يتجاوز قيمة الدفعة المقدمة، سيتم فوترة العميل بالمبلغ المتبقي المستحق بناءً على نسبة الإنجاز.

•إلغاء من قبل المصمم: يحتفظ موقع “أنس للتصميم الجرافيكي” بالحق في إلغاء المشروع في حال عدم تعاون العميل، أو تأخره في الرد لفترة تزيد عن 30 يوماً، أو انتهاكه لأي من شروط هذه الاتفاقية. في هذه الحالة، سيتم تسليم ما تم إنجازه للعميل، ولن يتم استرداد أي مبالغ مدفوعة.

8. السرية

نلتزم بالحفاظ على سرية جميع المعلومات، والبيانات، وخطط الأعمال التي يشاركها العميل معنا لأغراض إنجاز المشروع. لن يتم الإفصاح عن هذه المعلومات لأي طرف ثالث دون موافقة كتابية مسبقة من العميل.

9. إخلاء المسؤولية وتحديد المسؤولية

•يُبذل موقع “أنس للتصميم الجرافيكي” قصارى جهده لتقديم تصاميم خالية من الأخطاء، ولكن تقع على عاتق العميل مسؤولية المراجعة النهائية والتدقيق اللغوي والإملائي لجميع النصوص قبل الموافقة النهائية وقبل الطباعة أو النشر. لا نتحمل أي مسؤولية عن أي أخطاء يتم اكتشافها بعد الموافقة النهائية.

•لا يتحمل الموقع أي مسؤولية عن أي أضرار غير مباشرة، أو عرضية، أو تبعية (بما في ذلك خسارة الأرباح أو البيانات) تنشأ عن استخدام أو عدم القدرة على استخدام التصاميم المقدمة.

10. التعديلات على شروط الخدمة

يحتفظ موقع “أنس للتصميم الجرافيكي” بالحق في تحديث أو تعديل شروط الخدمة هذه في أي وقت. سيتم نشر أي تغييرات على هذه الصفحة مع تحديث “تاريخ آخر تحديث” في أعلى الوثيقة. استمرار استخدامك للموقع أو خدماتنا بعد نشر التعديلات يُعد قبولاً منك للشروط الجديدة.

11. القانون المطبق وحل النزاعات

تخضع هذه الشروط والأحكام وتُفسر وفقاً للقوانين المعمول بها في الدولة التي يعمل منها موقع “أنس للتصميم الجرافيكي”. في حال نشوء أي نزاع يتعلق بهذه الشروط أو بالخدمات المقدمة، يتم السعي لحله ودياً في المقام الأول، وفي حال تعذر ذلك، يتم اللجوء إلى المحاكم المختصة.

Welcome to Anas Graphic Design. Please read the following Terms of Service carefully before using the website or requesting any of our services. By accessing our website or using our services, you agree to be bound by these Terms and Conditions. If you do not agree to any part of these Terms, please do not use our services.

  1. Introduction and Acceptance of Terms

This document constitutes a legally binding agreement between you (referred to as the “Client” or “User”) and Anas Graphic Design (referred to as “we,” “the Website,” or “the Designer”). These Terms govern your use of the Website and all services offered through it.

  1. Scope of Services

Anas Graphic Design offers a diverse range of graphic design services, which may include, but are not limited to: logo design, visual identity, print design, social media design, and user interface design. The exact scope of work, final deliverables, and timeline for each project are defined in a separate “Quote” or “Project Agreement” agreed upon before work commences.

  1. Client Obligations

To ensure a smooth workflow and deliver the best results, the client agrees to the following:

  • Provide a clear and detailed brief outlining the project requirements and objectives.
  • Provide all necessary materials (such as text, high-resolution images, and previous logos) in a timely manner.
  • Respond to inquiries and provide feedback on drafts within a reasonable timeframe not exceeding three business days to avoid project delays.
  • The client guarantees that they possess the legal rights to use any materials, text, or images provided to the designer for inclusion in the design and assumes full responsibility for any infringement of third-party intellectual property rights.
  1. Revisions and Modifications Policy

We believe in client satisfaction, and therefore offer a clear revision policy:

  • Each project includes a specified number of revision rounds (usually 2-3), which are outlined in the project agreement.
  • Revisions include changes to colors, fonts, or minor layout adjustments, but do not include altering the core concept once it has been approved.
  • Any additional revision requests exceeding the agreed-upon number, or requests to completely change the core concept, will be subject to additional fees assessed based on the scope of work required.
  1. Fees and Payment Terms

All projects are subject to the following payment terms unless otherwise agreed upon in writing:

  • Advance Payment: A non-refundable deposit of 50% of the total project value is required before any design work begins.
  • Final Payment: The remaining 50% is due upon final design approval and before delivery of the high-resolution source or final files.
  • Payment Methods: We accept payment via bank transfer or approved electronic payment gateways as detailed in the invoice.
  • Payment Delay: If the client fails to pay the final installment within 14 days of the final approval date, we reserve the right to suspend file delivery and may impose late fees.
  1. Intellectual Property Rights and Usage Rights

Intellectual property rights are among the most important contractual provisions in graphic design:

  • Ownership of Final Designs: Upon receipt of the full final payment, the commercial use rights for the approved final design are transferred to the client.
  • Source Files: Unless otherwise stipulated in the project agreement, open source files (such as PSD and AI files) remain the property of Anas Graphic Design. The client may purchase source files for an additional fee.
  • Rejected Drafts and Ideas: All concepts, drafts, and ideas submitted to the client and not selected remain the exclusive property of Anas Graphic Design. The client is not entitled to use or modify them.
  • Portfolio Display Rights: Anas Graphic Design reserves the right to display the final designs in its portfolio, on its website, and on its social media accounts for promotional purposes, unless the client explicitly requests confidentiality before work commences.
  1. Cancellation and Refund
  • Client Cancellation: If the client decides to cancel the project after work has begun, the 50% deposit is non-refundable to cover the time and effort expended. If the completed work exceeds the value of the deposit, the client will be billed for the remaining balance based on the percentage of work completed.
  • Designer Cancellation: Anas Graphic Design reserves the right to cancel the project if the client fails to cooperate, does not respond within 30 days, or violates any of the terms of this agreement. In this case, the completed work will be delivered to the client, and no refunds will be issued.
  1. Confidentiality

We are committed to maintaining the confidentiality of all information, data, and business plans shared with us by the client for project completion. This information will not be disclosed to any third party without the client’s prior written consent.

  1. Disclaimer and Limitation of Liability
  • Anas Graphic Design makes every effort to provide error-free designs; however, the client is responsible for the final review and proofreading of all texts before final approval and prior to printing or publication. We are not liable for any errors discovered after final approval.
  • Anas Graphic Design is not liable for any indirect, incidental, or consequential damages (including loss of profits or data) arising from the use of, or inability to use, the submitted designs.
  1. Amendments to the Terms of Service

Anas Graphic Design reserves the right to update or modify these Terms of Service at any time. Any changes will be posted on this page with the “Last Updated Date”

  1. Applicable Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the country in which Anas Graphic Design operates. Any dispute arising from these Terms or the Services provided shall be resolved amicably. If this proves impossible, the matter shall be referred to the competent courts.
